Alimony / Spousal Support

Spousal support payments, often referred to as Alimony payments, are determined by many factors and are unique to each divorce case. Quoting from a brief issued by the Florida Supreme Court in 2004,

Florida courts have consistently held that alimony must be based on ability to pay, not future projections; and, that income may be imputed to a party only when that party has voluntarily limited his/her income.

Alimony is used to provide the spouse that is making a lower-income with funds to cover expenses that are not provided for through child support or through the division of property. If children are involved, the child support payments will be determined using strict guidelines provided by the State of Florida, whereas the judge is often the deciding factor in whether or not alimony (spousal support) will be awarded.
